"We", "us", "our", "Aquilon", "Company" shall refer to Aquilon Advisory LLP, its employees, and its service providers that undertake to make investment recommendations or conduct security analysis and perform any other services incidental thereto on its behalf.
“You”, “Your”, “Customer”, “User” shall refer to the sender, customer, person viewing the website, or any other party having a legal interest in those contents, as the case may be.
“Applicable Law” means all laws, statutes, ordinance, regulations, guidelines, policies, rules, bye-laws, notifications, directions, directives and orders or other governmental restrictions or any similar form of decision of, or determination by, or any interpretation, administration and other pronouncements having the effect of law of the Republic of India or any other applicable jurisdiction by state, municipality, court, tribunal, government, ministry, department, commission, arbitrator or board or such other body which has the force of law in India.
These Terms of Use govern access and use of the Aquilon Website. By accessing and using the Aquilon Website, you certify that you have read and you understand these Terms of Use. By agreeing to these Terms of Use on behalf of an organization, you certify that you have the authority of that organization to enter into these Terms of Use. If you do not agree to these Terms of Use, you must cease all use of the Aquilon Website. The Aquilon Website is intended for use only by individuals 18 years of age and older. You are not permitted to and shall not provide us with personal information if you are under 18 years of age.
Aquilon reserves the right to modify or discontinue the Aquilon website with or without notice to you. Aquilon will not be liable to you or any third party should it exercise its right to modify or discontinue the Aquilon website. If you object to any such changes, your sole recourse will be to cease access to the Aquilon website and any content accessed through the Aquilon website.

Information including but not limited to name, place, address, bank statements or any other financial information of the User, which the User has given permission to collect or has provided our agents, vendors or any service providers for that matter comes in the virtue of personal information.
In no case may you-
a. Decompile, reverse engineer, disassemble, modify, distribute, or create derivative works or improvements from the Aquilon Website or any portion thereof, or attempt to discover any source code, protocols, or other trade secrets in the Aquilon Website;
b. Obtain or attempt to obtain unauthorized access to Aquilon’s Website or network;
c. Use the Aquilon Website in violation of applicable laws or regulations;
d. Develop or create a database of data using the Aquilon Website, except as expressly permitted by any other terms of use on the Aquilon Website;
e. Alter or modify the content of the Aquilon Website;
f. Launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the Application;
g. Use the Aquilon Website in any unlawful, fraudulent, misleading, obscene, harmful, threatening, harassing, defamatory, or hateful manner, that invades the privacy of any third party, for any unlawful purpose, or in any manner inconsistent with these Terms of Use;
h. Use the Aquilon Website or Licensed Marks in a manner that infringes, violates, or misappropriates Aquilon’s, its affiliates’, or a third party’s intellectual property rights;
i. Use the Aquilon Website for any purposes for which you have not been granted written permission by Aquilon.
You are solely responsible for any breach of your obligations under these Terms (including financial obligations) and for the consequences (including any loss or damage which User or Aquilon may suffer) as a result any such breach.
Aquilon reserves the right to suspend, terminate, or block your access to the Aquilon Website with or without notice to you, in the event that Aquilon believes that you have violated any provision of these Terms of Use.
a. You may make use of our Services through our online web gate or any other online mechanisms and through communication with our relationship directors, Investment directors, Service Manager as the case may be.
b. Aquilon complies with all regulations and compliances as per Indian law. If you are accessing our Services from any jurisdiction outside India, you will be responsible for the compliance with your local laws.
c. Some of the Services, provided by us or our Service Partners, may have restrictions on use depending on criteria such as, but not limited to, your place of residence, nationality, age, wealth, source of income/wealth etc. You agree to provide accurate information for us and our Service Partners to comply with such restrictions.
d. If you have accepted to provide us with your personal details, such as email or phone number, we may send you announcements, messages or information on our Services and how to use them. You may opt out of some of these messages unless they are necessary for the delivery of Services; for compliance with regulations; or, for information security, for e.g., password change alerts cannot be opted out of.
e. Some of the Services, provided by us or our Service Partners, may have restrictions on use depending on criteria such as, but not limited to, your place of residence, nationality, age, wealth, source of income/wealth etc. You agree to provide accurate information for us and our Service Partners to comply with such restrictions.
f. You agree that in the event the Services rendered by Aquilon under this Agreement are availed by multiple persons, then, Client 1 will be designated as the primary contact and appointed as the single point of contact by the signatories of this Agreement. The primary contact shall communicate with Aquilon with respect to this Agreement and any other matters pertaining to the Client’s accounts. Any change in the designated primary contact shall forthwith be communicated to Aquilon, in writing. In case of a legal entity, the primary contact shall be the person duly authorised by the legal entity to sign this agreement.
g. Your clicking on the “I accept” checkbox is the legal equivalent of your signing this Agreement and accepting the terms thereof. Utilisation of certain Services shall require your additional consent which shall be recorded as and when you choose to utilise such Services. Any additional details or information regarding provision of any Services, as required by Applicable Law, shall be displayed to you prior to your utilisation of any such Services.
h. Please don’t misuse, disrupt, interrupt, destroy or limit the functionality of our Services; or try to access them using a method other than the interface and the instructions that we provide. If you do so, we may stop providing our Services to you and pursue legal action against you.
You may need to meet certain threshold requirements, to be an Aquilon Client. Aquilon reserves the right to add certain stipulations for offering services for the choice made by you.
You acknowledge and agree that, for the provision of Services under this Agreement:
a. Aquilon shall carry out all activities that are required to fulfil its regulatory obligations for the provision of Services under this Agreement.
b. Your access to our Services is associated with a username and password (together “Login Credentials”) and Aquilon will consider the instructions placed with the use of your Login Credentials to have originated from You. You are solely responsible for the security of your Login Credentials. Aquilon shall not be held liable for carrying out any instructions placed from your account utilising your Login Credentials which may be unauthorized due to any reason including an information leak or security breach on your part.
c. Aquilon may utilise third party vendors (“Vendors”) for support in provision of Services.
d. Aquilon, or its Vendors, may:
Contact you on issues relating to provision of Services;
Communicate with its Service Partners or Manufacturers and their authorized service providers on your behalf for financial or non-financial transactions;
Record all your interactions with them including phone calls, chats, conversations and emails, with its employees for legal compliance, security, employee training, and other lawful purposes.
e. Any sort of graphical representations, recommendations, feedback and reviews, provided on the investment platform, are in no way a guarantee for the performance of the securities, mutual funds and other financial products.
f. Other than as expressly set out in this Agreement, neither Aquilon nor any of its Service Partners, as the case may be, make any specific promises about the Services provided. The Services are provided as is.
g. Your bank may charge you a fee for facilitating transactions, or for failing to maintain sufficient balance to make an investment from your bank account. Aquilon does not levy nor does it receive those charges.
In no case should any information published on the website be construed as a financial or investment advice of any kind. The information published is for the knowledge purpose only and if in case any financial action is taken on behalf of the knowledge provided on the website, the User will be solely responsible it.

Limitation of Liability : Aquilon is not liable for any damages that may occur to you as a result of your misuse of our website. Aquilon reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Aquilon and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
Severability : In case any one or more of the provisions contained in these terms and conditions shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision of these terms and conditions, but these terms and conditions shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein and there shall be deemed substituted for such invalid, illegal or unenforceable provision such other provision as will most nearly accomplish the intent of the Parties to the extent permitted by the applicable law.
Governing Law and Jurisdiction : This Agreement shall be governed and construed with the laws of India. The Courts at Bengaluru, India shall have the exclusive jurisdiction to determine any Dispute arising out of, under, or in relation to any of the matters contained in this Agreement.
